Shawn Maggard Terminated with 2 – 1 Vote – Judge Dues Requests Pay Raises For his employees

File 2 of this meeting had an economic development update by Shawnda Combs. It was a good meeting but even with the poor economy this meeting at best did not crack the top two meetings of interest for the day.

File 10 had an Executive Session to talk about the possible discipline of a county employee. The Commissioners came out and gave the “No action taken” comment but they were by no means done.  Shawn Maggard then came in and another Executive Session was held after which a long county career was terminated with a 2 – 1 vote. I have transcribed it as best I could, the audio is provided but all that is clear is that there apparently was an apology made and it was not enough. Shocking, sad and Resolution #155-11-149 became a career ender. Offhand I wonder if the 2 – 1 vote leads to a challenge on the termination. This file was transcribed.

Another interesting meeting was File 11 this section was set off by six letters from Judge Dues. There is reference to the letters and the Judge using the fact that Governor Kasich recently hired people at a rate higher than former Governor Strickland to justify giving pay raises to the Judge’s employees also. This did not sit well with the Commissioners and there is an almost 30 minute meeting on the issue. The heart of the argument was that everyone else in the courthouse is working harder with less and not getting a pay raise. Basically the same argument that was made when the Engineer essentially thumbed his nose at the Commission and gave pay raises anyhow. The judge did not make these raises a court order so the commissioners noted receipt of his letters without granting the raises. Stay tuned. This file was transcribed.

File 12 has further discussion of the Barracuda web filter and a decision to write and send out a memo informing the commission's courthouse employees why the decision to block social websites was made on Monday.  I know what many of you are thinking; if everybody is working so hard and making do with less, how can this be an issue?  This essentially means that if an employee job is under commission oversight they will not be getting a pay raise and if their office uses the commission internet connection then they cannot serf social networks. Commissioner Stonecash – Ahh well I'll go first. I ahh as I said 30 days ago or approximately. I don't know the exact number of days but we did meet with all of you during the interview process and also together and we covered these sorts of things that we no longer wanted to happen that happened in the past. And ahh this is a very unfortunate situation causes us a lot of mental grief either way. Ahh the very sad part of it that the remarks were made about our acting Administrator who you directly work under. I don't know that gap could ever be bridged at this point. Plus the fact that the remarks were made in front of another female. I have a great amount of respect for your abilities as GIS person in Preble County.  I'll wait to hear from these guys before I pass my final opinion.

Commissioner Stonecash – and the amount of the proposed

Connie – I don't know whether it is proposed. I believe it is already in effect because the date of the letter to the Auditor is February 6. I believe the individuals will be receiving their rate adjustments February 19. On their paychecks received February 19.

Commissioner Stonecash – Well that's unfortunate that all of our county employees at this time can't have a raise. And the letter it is noted that Governor Kasich has hired some people at a higher rate than Strickland's people and to me that really doesn't make any difference to Preble County. I just have a problem with the fairness of it to everybody in the county employment.  

Commissioner Wesler – I very much agree with this as you may recall I voted no on the budget last year simply because some pay increases were being given. And now ahhm this letter was dated February 6 and you received it when? Connie?

Connie –  I received it yesterday (February 15) which was February 14, 2011 or 15 excuse me 15th.

Commissioner Wesler – 15th So in other words the payroll date they should be receiving the ahh this Friday a check indicating an increase in some of these employees and ahhm here's the kicker; Our budget is the same as last year and within that budget so I guess what it means if you have you know 10 employees and you reduce down to nine, still you have that one person still in your budget because they may have retired or you did attrition with them you know something like that. And they used that money, that salary for that one person to give pay raises within with in ahh their budget. And that is just not right. Did we allow some of the others upstairs to do that? No.  So ahhmm and we're not Governor Kasich may have done that but we're not the state of Ohio. And also I'm disappointed that he helped create a surplus of 2.1 million dollars while evidently he has not been keeping up with the state because we're going to be reduced this next year and that is hardly any kind of a surplus. We have heard of other counties carrying you know 14 – 15 million dollar surplus. So don't be complacent that we have a 2.1 million carry over. You know he cited that but yet here on ahh on February 14 it came down to $1.9 million so it can fluctuate several hundred thousand within a week or within actually a couple weeks. So don't be complacent with what we have. But once again this is just totally unfair and I'll again stick up for the rest of the employees that didn't get pay raises. I don't agree with the logic that just because there's reduced employees in his ahh in his court that he can take that excess money and distribute it out to give pay increases. Do you have a comment Chris?

Commissioner Day – No, just that it very unfortunate that ahh people ahh and throughout the rest of the county work force are not receiving raises. And like I say because some people can reduce through attrition or whatever. They're utilizing those monies, I understand everybody is doing more with less. Everybody is working harder but ahhm I guess what we have to look at now is ahhh what it would cost to give a 45 per cent raise roughly across the board for everybody else in the county. That is what it came out to is about a 4% increase across those six employees I believe.  

Connie – I do want to take you down to the last sentence because I think Bob you are right these aren't in effect yet. It says please begin the new rate with the payroll date beginning February 19.

Commissioner Wesler – So you are talking about from February 19th on?

Connie – It says; Please begin the new rate. With the following with payroll date beginning February 19.

Commissioner Stonecash – Well it is approximately $9,422 hit to the budget.

Connie – Well if you look through all of his letters that last sentence they indicate different dates.

Commissioner Stonecash – But on the first page it indicates that ahh he is going to spread it out over seven pays to reduce the cost within the existing budget.

Commissioner Wesler – Every two weeks he starts a new one.

Commissioner Stonecash – I ahh I'm like Chris I as I stated a minute ago, I wish we could give everybody a raise but until we find out what is coming down from the state ahh we need to be very conservative ahh and it is just unfair to the rest of the employees for a few to get a raise and the rest of them not to get a raise. So I would ahh

Commissioner Wesler – Connie, this is not "Court ordered"

Connie – No it isn't.

Commissioner Stonecash – I agree that it probably should be court ordered if that is going to be his desires. He does run a very good efficient office but ahh we're all still doing more with less and anticipating serious cuts from the state of Ohio. Which might come back to haunt us and ahh might affect us in that there might be more ???.

Connie – So you would rather have this action taken in a court order form?

Commissioner Wesler – Well or if we just say we noted receipt of your letter but we're not instructing Mindy to give the raises.

Connie – I don't think I, once the appropriation is in his line item ahh he can do whatever he wishes.

Commissioner Day – Correct

Commissioner Wesler – Ok, when somebody quits from now on Connie we've got to take it out of the line item right then.

Connie – Right

Commissioner Wesler – When Ken Moreland retired you didn't take his salary and just distribute it amongst everybody.

Connie – No it was taken out. That was one of our major major reductions.

Commissioner Wesler – Can we put a tag on that from on now? Anybody that retires and they say they don't need that person, it's taken out. Now back in Judge Dues's budget he had that money in there for a part time clerk – part time hire. Now is that part of his money? Because we got a letter later saying that he was going to take that money, not hire somebody part time but evidently distribute it which is partially what he is doing here. Do you remember that?

Connie – Yeah I remember that.

Commissioner Wesler – Well if he didn't hire somebody as he stated in his budget, we need to pull that back.

Commissioner Stonecash – Can you do that after we approved the budget?

Commissioner Stonecash – Can we do that after we approved the appropriation? I guess we can.

Commissioner Day – What's that?

Commissioner Wesler – No, with his budget he came in and said "I'm hiring a part time person". It wasn't no name there, at "x" amount of dollars and we approve it based on that. It was later that he came back and said "We're not going to hire that person now but I am going to give everybody else a raise, since you know not going to do that job". So and I agree, Judge Dues's ladies everybody around the courthouse does a good job and works hard.  We asked them all to work harder work smarter but yet again if you have ten ladies or ten people working and you go down one, you can't just distribute that salary to everybody else. Everybody else is doing more around here with less. So this is an unfair move. Did ahh when Jeannie when Bill Spahr retired did Jeannie take the money ahhh oh it probably wasn't appropriated the next year. But if somebody quits in the middle of the year, you got to pull that money back.

Connie – You know a lot of that was taken when we had that large reduction. I mean that was a very large what was it eight? Seven, eight?

Commissioner Day – So what you would like to propose David is if there is any reduction in staff due to attrition whatever

Commissioner Wesler – Correct

Commissioner Day – that you go back and pull that out of their appropriations.

Commissioner Wesler – Well Chris if they don't, they come and they say we are not going to replace employee because we can get by without them. Then the next thing you know they say; Hey, guess what we've got this money in the account let's give everybody in our office a pay raise.

Commissioner Day – I understand but basically what you are saying is at that point you want to micro manage each individual department

Commissioner Wesler – While then why didn't we take Ken Moreland's money and distribute and give all of us a huge raise? Connie got a raise because she was acting county administrator at that time and still is. So we have a I mean, I understand what you are saying Chris because I don't like to micromanage but yet again I don't like to have our buttons pushed down here with these salaries. You and you both signed a letter saying no salary increases for this last year and I did to. Did everybody listen? No they did not.  Ok these increases go into effect, what happens if you think you think you can give the increase half way during this year? Bob you've talked about it,. Do these people get increases to?

Commissioner Stonecash – Ahh when I talked about it I said the people that had not received.

Commissioner Wesler – Oh ok.

Commissioner Stonecash – I don't know that you can do that but

Commissioner Wesler – Yeah

Commissioner Stonecash – but and I have always been ahhh more for merit raises than across the board because some people deserve raises and some don't. Whether we can operate on merit raises or not, I don't know but it is an appropriate thing and that basically is what he is saying right here. Are merit raises.

Commissioner Wesler – You go to any other office around the courthouse and they will agree with you that if they could give merit raises or raises to everybody in they're office. Same with us you see our ladies out here working but their not getting raises.

Commissioner Stonecash – Ahh I know and that is what where merit raises could be applied. Because they

Commissioner Wesler – If we had the money.

Commissioner Stonecash – Right

Commissioner Wesler – We're still bracing for state cuts.

Commissioner Stonecash – That is what I said a few minutes ago. That we don't know what is coming and to base that on this sentence that Governor Kasich ahh gave some significant raises to his people ahhh doesn't apply to Preble County. Now you voice that concern to Governor Kasich. So what is the appropriate resolve here? To note receipt of the letters but

Connie – Yes or no we have not done that.

Commissioner Wesler – Ok, to note receipt of these letters. The first one is to Marianne Schmidt with a new rate of pay beginning February 19, from $11.89 to $12.48. The next on is ahhm Penny McQuire from $18.53 to $19.46 starting March 5. Jennifer Overmeyer from $34.40 to $36.50 beginning March 19th. Joanne Barker from $11.34 to $11.68 beginning April 2. Elizabeth O'Connell from $10.80 to $11.12 beginning April 16. Donna John from $21.75 to $22 beginning April 30.  Ahhm ok I move we note receipt.

Commissioner Wesler – And see here is the other thing there is one employee that has reduced hours and because of that they're giving small increases to the others to ahhm so basically when that person comes back full time; Are some of the pay raises going to be pulled back? No.

Commissioner Stonecash – You know we are in ahh we may be in a situation in this country where people don't get raises every time they turn around. It's been taken for granted that in a lot of cases people get a raise every six months or every year automatically. That situation could change. Anyway.

Commissioner Wesler – But down here it says the continued reduced hours of the employee. So when that employee comes back

Commissioner Wesler – The government's salaries have grown.

Commissioner Stonecash – Yes, they have. And I think we heard this morning from ahh from this afternoon that said government salaries have surpassed private industry.

Commissioner Wesler – mmhh

Commissioner Stonecash – By a good bit. That doesn't apply to everybody of course. Ok, I'm done.

Commissioner Stonecash – I just have a concern from our discussions on Barracuda the other day. I really don't know how to handle it but and I know we are going to make some changes. Ahh but to just make those changes without notifying the person or person that are using it, I think we have to someway send them a letter or talk to em and tell them why that has been changed. Rather than to just do it and let it go. Maybe you guys think that is enough and I will accept that but if you abuse your privileges I think you ought to be addressed to that fact. So, leave it for your discussion.

Commissioner Wesler – Yeah, I understand what you are saying and that is why we did take the action that we did across the board. Ahhm

Commissioner Stonecash – Maybe it could be handled by everybody getting a memo.

Commissioner Day – Probably the proper way to do it would be to draft a memo, send to all of our offices stating that this is one action being taken to limit the use of social websites

Commissioner Wesler – Improve productivity in their offices.

Commissioner Stonecash – There you go. Very good

Commissioner Day – And that the internet is for county business and county business only and that if private business is conducted it is unacceptable.

Commissioner Stonecash – I did stop in at Stan's to inquire about the but they haven't gotten back to me yet.

Commissioner Day – The President can draft a memo, to all departments.

Commissioner Stonecash – You know I just think it is fair to do that. Once in a while you got to tell them what is going on and what they have to do to comply.

Commissioner Wesler – Anything else?

Commissioner Wesler – Connie what about the warrants? The vouchers for next week?

Commissioner Day – Can't we do them Wednesday?
