Pork Festival Threatening To Leave Preble County?

Commissioner David Wesler spoke the words “that there may never be another Pork Festival in this county again.”  Commission President Robert Stonecash replied: people have told me that they have had discussions with Darke County. "Anybody in Preble County that would make that threat to move something out of Preble County to another county is way out of line. They are not thinking of Preble County first. They are thinking of themselves"

On a day the commission agenda showed no meetings time was pretty much dominated by the ongoing Pork Festival – Agricultural Society issue. Tensions were further heightened with the reading into the record of a letter sent by the Pork Festival attorney to the Ag Society. In addition to the six points of concern listed in the letter was a threat to lock up the Expo building and not allow the Ag Society use until written requests are made with proper accompanying documents for future events. The letter included a suggestion that the “Society” remove dirt from the Expo Building before February 6, 2010.

The Ag Society has a tractor pull scheduled that is the latest round of contention over reasonable use of the $750,000 building that had a $90,000 concrete floor put in before the last Pork Fest.

As a possible sign of frustration over the continuing dispute County Commissioner Bob Stonecash even raised the possibility of selling the fairgrounds. The County Commissioners hold title to the property for the people of Preble County. Katie Worthington was called into chambers for discussion on what legal power the commissioners have over the Fairgrounds.

At least some Pork Festival leaders have concerns over planned use of the Expo Building for upcoming tractor pulls. The problems appear to go back much further with the current round having started over the condition of the Expo Building prior to the 2009 Pork Fest.

The Preble County Commissioners also voiced concerns over the management of the Preble County Fairgrounds. Among concerns noted was oil from tractor pulls being drained onto the ground at the property, running faucets, outdoor lighting left on for lack of replacement of photo cells, doors off of hinges, locks on buildings that did not work, vents at the Expo building and the general lack of even paint for appearance. Discussion of hiring an event manager to handle the bookings for the property and dealings with both the Ag Society and the Pork Fest was also a topic.

Among other issues apparent is the prospect that not all of either the Pork Fest Board members or the Ag Society members may be fully aware of not only the issues faced or the conduct of others on their own respective committees.

Dear Sirs,

Preble County Pork Festival has directed me to send the hereto attached letter to the Preble County Agricultural Society. The Pork Festival Board of Directors feels that the actions and conduct of the Agricultural Society on the issue of motorized vehicle events in the Expo building puts the $750,000 building of the Pork Festival organization, the Preble County Commissioners and the citizens of Preble County at unjustifiable risk.  Further the moving of dirt is a clear unmistakable communication of the Agricultural Society’s attitude regarding the Pork Festival, the Commissioners and the citizens of Preble County. The Board of Directors of the Pork Festival has come to the conclusion that it is obligated to act.

Letter to the Preble County Agricultural Society:

Dear Sirs,

On behalf of the Preble County Pork Festival, herein referred to as Pork Festival. This letter with serve the purpose of notifying the Preble County Agricultural Society, herein referred to as Society and its board of directors. That as things now stand the Pork Festival has grave concerns about the Society’s intended use of the Expo building. Motorized events more specifically – tractor pulls, truck pulls and the demolition derby scheduled for February and March 2010. In order to give the Society of some of the basis for the Pork Festival’s concerns, positions, please consider the following.

1.      To date the Pork Festival has not received a written request from the Society to use the Expo Building for these motorized events.

2.      To date, the Pork Festival has received no copies of resolutions minutes or contractual agreements evidencing the fact that either the Society’s Board of Directors of the Society’s Executive Committee has approved contracts between the Society and the various third parties involved.

3.      To date, the Society has received no copies of applications, permits or letters from the State Building Inspection Department, Fire Marshall or the Preble County Sheriff’s Department demonstrating approval from the departments of the events contemplated.

4.      To date Pork Festival has received no safety plan or safety procedures from the Society setting forth the planned measures, including dual protective barriers that the Society will take to protect both spectators and the Expo Building.

5.      To date Pork Festival has not received from the Society copies of insurance contracts from each contemplated event.  For which adequate insurance amounts have been purchased and on which the Pork Festival is a named insured.

6.      In short the motorized events as presently contemplated do not fall under reasonable and or customary use of the Expo Building. Nor do they comply with the law.

Folks there are only 17 days until your first pull set up is scheduled. At the meeting before the county commissioners you heard Shaun Murphy of Murphy Insurance express the opinion that an inherently dangerous event such as a tractor pull should have minimum $10,000,000 special event insurance. It is the understanding of the Pork Festival that as of February 1, 2010, the Society has zero dollar special event insurance on these events. Furthermore of concern to the Pork Festival is the approach the Society has taken in dealing with the Pork Festival on this subject. Specifically when asked by the county commissioners not to move dirt onto the $90,000 new concrete until January 27, 2010, commissioners meeting could occur. Less than a week after the request was made the Society thumbed its nose at the Preble County Pork Festival and the Commissioners by going ahead and moving the dirt with large ??? during the intervening weekend. This approach is best described as indifferent, as completely inappropriate with dealing with a $750,000 community asset and relations with government and community benefiting organizations. Consequently because of the points set forth above and others not included in this letter will put the Society on notice that on Saturday February 6, 2010 the Expo Building will be locked up by the Pork Festival and the Society will not be allowed to use the Expo Building until proper written requests are made with proper accompanying documents for future events. The Pork Festival suggests that the Society remove the dirt from the Expo Building before February 6, 2010.

31.6 minute mark    Dave – "Bob, our committee was exactly going to try and tackle this situation. That's where the Woolpert Study came into play. So we thought well let's back off and see what the Woolpert Study says. But in the mean time there has been no discussion on whether these tractor pulls could – should or will be held. It was just the Ag Society saying well we're going to do it. So, I guess where I am coming from, I've got to think back over the years of how the Pork Festival has helped the Fairgrounds and it has helped the county. I believe they have done a remarkable job. Back when the performance audit came out, instead of paying the Ag Society a certain amount each year, they said we're going to build this Expo building.  You can understand they put a lot of sweat equity into deciding and building that building down there. They thought, this will give the Ag Society more revenue to rent the building out of which very little has been done of which there is certain reasons why.  Because, I remember at the 11th hour down there, they had to put in wash racks just for the Fair, because they wanted wash racks that were close by the Expo building. Ahhm certain things like that might not have been thought out at the 11th hour very well. But the Expo building is.. you guys can recall walking through there this Pork Festival, how a lot of the vendors were really enthused about the concrete being down and were enthused that the dust wasn't getting on their different items that they were selling. I can also recall that there was also discussion about having a Christmas fair or crafts show down there. I guess is what I am trying to say and maybe even a couple through the year. Which would give additional revenue to the Ag Society or whoever? Then all this came about that the Pork Festival came in and part of their demand…request was that they wanted to be able to rent the Expo Center out. They thought they could do it better than the Ag Society and try to market it, but at that time we hadn't gotten into that discussion because I hate that it has to be two people that you have to call to rent the entire fairgrounds. I don't think that is good. Back at the time I had called a gentleman from Wayne County, Ohio, who somebody told me they rent out there fairgrounds up there and they have multiple building like we do. They said that place is hopping every weekend. The gentleman up there said "I've been here twenty four years, he I listened too… I do the best I can to bend over backwards for the vendors that want to come in here and do different projects and it's built up over the years. It takes time but he said I would give anything in this county if I had a Pork Festival that would help put in the dollars that our Pork Festival has. I know that I've got various documents here about the additional money that the Pork Festival has pumped in and I think its somewhere about $1.7 million. Between the Brewer Arena building, the Expo building and numerous other projects that they've done.  Not, let alone the additional land that they want to go out to the east and exit on Wayne Trace Rd, which nothings ever been done with that. So, there has been some discussion to bring that back up again. So, I guess what I am saying guys are like you said Bob "Are we going to make a statement here or not?"

I'm going to say that:

A.  The Ag Society isn't AHM… united in whether to have this event or not. There have been additional events that will offset a tractor pull. That being a Dog Show. I had a letter from that St Clair.Kennel that said they were moving out unless there was concrete. That will offset probably the dollars in revenue of the tractor pulls. The additional events at Christmas time with a craft show ahh stuff like that ahm and I will go back is it a reasonable use? I don't think the Pork Festival ever thought that, that building was ever going to be used for a tractor pull or a monster truck show.

37.5 minute mark   Dave – I believe the statement has been made that Pork Festival members..board members have been asked to resign, have nothing else left to do but resign from the Pork Festival Board and the potential that there may never be another Pork Festival in this county again, has been made. It all goes back to this tractor pull liability. The blatant disregard to your requests to moving dirt into the building. The past history of the building being dirty, of the improper use of the vents and proper maintenance of the door locks. It just has come to a head. It’s unfortunate but that where we are at now.

42.5 minute mark   Dave – Well that's correct and that how we came to the solution with the concrete. One board said yes, the other board said no and we made the decision. And it was going to be next Chris, its unfortunate that the board…we quit meeting, we didn't want to sort of step on the toes of Woolpert and their investigation of what's going on. But that was exactly going to be the next thing we talked about is the tractor pull. Is it worth it? Is it a reasonable use? Is you know what is the proper amount of insurance.. safety issues. That is what we were going to tackle next.

Dave – I ahh, I called … Mike.. well first of all I just called – I was called down there last Friday to .. when Dana Brewer sp?? and Jim Akren sp?? came down there and they had a lot of questions. And they talked with Martin  sp??son. Ahhhm they talked a lot with the Pork Festival.  He described information basically and said I'll be back next Thursday to give you a report. And I think tomorrow, sometime 11:00 or 12:00 something like that they got a meeting at the city building.

Bob – to see if any permits had been applied for or anything.. just a few minutes and there hasn't.

44. 25 minute mark   Dave- so fast forward here then, I think on Tuesday – Monday or Tuesday. I called the members of the Pork Festival and asked if they could meet…  just the three people. Asked if they could meet this Thursday, tomorrow (February 4, 2010)  and I was told they had some conflicts and they couldn't and I said what about Friday or Saturday? Let me know. That's when one of the members said well what good is it going to do us what good is it? And so I think he had already turned up his hands at that point.

Bob – Is it appropriate for me to ask who that is?

Dave – That was Jesse Glander

Bob – if he looks at it that direction then he has to step out of the way and let somebody else do it.  You have to keep working until you reach a solution.

Chris – We have had these same discussions for a year since I have been here and it is obvious what you just said David. There has to be somebody running the facility…. that the two bodies report to or work with for their event. It sounds to me that you (David)  are the site manager right now. So at this point in time I think it's appropriate that you assume all duties for the site manager's position and will move forward.

 46.2 minute mark      Dave – Also keep in mind the Pork Festival's request a while back to take over renting that fairgrounds out or renting the Expo building out. So they can get additional revenue for the next phase of the building. Which was the restrooms of which everybody agreed. You have to understand that the Pork Festival is paying off their loan presently for the building. If they take on more bonds, they need some revenue to pay that off. And I don't disagree with it.

 48.5 minute mark    Chris – … At this point in time we have to figure out what we are going to do with the facility. Because the Ag Society… my understanding… by statute … their interpretation is that because they have a fair they are in charge of the site. Is that correct?

Dave – that the way I have seen it yes.

Chris – now I don't know, I think that's a very gray area. I think that could be interpreted for the two weeks of the fair. So at some point in time and obviously the Ag Society has not done a good job over the years of managing the site. You've listened to the maintenance issues. I mean – we all went down there and spent a couple days walking around times and let’s face it guys the facility… Granted there has been something’s happen over the last year that have improved it but why did it get to that point to start with? I mean how many lights did we see that were on because the photo cells weren’t working? How many doors did we see off the hinges? How many locks didn’t work on buildings?

Dave – water faucets running..

Chris – a little bit of paint on building would go a long way. I guess what I keep hearing is that we have to come up with some plan to manage the site. We have to take these two agencies out of it… site management.

Dave – this is exactly where I thought the Woolpert study may help us out. The problem is that it is not going to be out for six months and we've got the issue now that we've got to deal with.

Bob  Who schedules all events including the Preble County Fair, when the Agricultural Society comes to us with a request for two weeks a year for them to have a fair. And the Pork Festival comes to this board and to take and prepare for two weeks a year for them to have a Pork Festival.  The rest of the year we see if there is.. if we can do it even and we probably can we own the ground, which mean probably everything on top the ground also comes with it. We see if we can hire an events manager to manage the fairgrounds 24 months a year.

I don't know where it started but I do know where it needs to stop and it is now. I think, I would admit as would most of our members that we have some problem people on our board and vice versa for the Pork Festival. Unfortunately some of those people have been involved in previous negotiations and in all honesty that was like sending a gunslinger to a tea party. You know, we people that are open minded, who understand the agreement in 2003 and 2005, who understand.. you know what your position is. You know our attorney has an opinion that is totally different than Gray's, so you know it’s just like we're 180 out and there is no need for this. It's just the most ridiculous thing I've ever dealt with. I know tonight at the meeting I am planning on saying that if you're not here for the good of the Fair and the good of the Pork Festival… get out. Because you’re wasting too much time, we're wasting too much time and the county people are the ones who are suffering so. People want us to play well together and unfortunately they have not played well together. But, I still think a group of people committed to getting all this buried and getting a new agreement that we would all agree on that is fair to both parties. I think that is what needs to be done and it needs to be done apparently by the 6th of February. Which is according to this thing Saturday. Like, I said, my opinion, we through a stone at them with moving the dirt. There throwing a stone back with this at us and we just got to quit throwing stones."

Pat Taylor –  I was told, Charlie's never seen the contract, I've never seen the contract, that it was a three year contract. In three years the entire board can turn over down there. In one year can be replaced and they could have been three "yes" votes for the tractor pull and now they're replaced by three "no" votes. So you know my comment is that we are not allowed to enter into multiple year contracts because we can't obligate people who follow us to someday something they may not want to do and that is one mistake. But again it’s just been the constant little digs that now its snow balled. It was the cleaning out of the Expo building that wasn’t done and then it just snow balled from there.

1 hr. 36 minute mark    Connie  on sending the Ag Society a bill for the fairgrounds landfill assessment (has been done in the past more as a FYI but never been paid) bill is for $1,637.14  .  All the other people that are on our property pay the solid waste assessment.

Bob – send them a bill and we expect payment.

1 hr. 38.4 minute mark   Bob – I want to get it on record that this board of commissioners loaned them $50,000.. when I am not sure…. I doubt most members on the board the Agricultural Society are aware of that. Do to the fact to say the least difficult at this time. I guess I for one that at some point hey begin to pay on that.
