DTAC LEGISLATION HEARD BEFORE HOUSE LOCAL GOVERNMENT COMMITTEE

On Wednesday, the House Local and Municipal Government and Public Administration

Committee heard testimony on a county budget bill (HB 233) dealing with DTAC funds.

The legislation, with bi-partisan sponsorship (Letson-D, Coley-R), would temporarily authorize

county treasurers and county prosecuting attorneys to designate any surplus balance in the

county’s Delinquent Tax and Assessment Collection (DTAC) Fund be use to pay operating

expenses of the respective office in lieu of county general fund money.

Offering support testimony was Hamilton County Assistant Administrator Christian Sigman, as

well as Hamilton County Assistant Prosecutor James Harper. Sigman noted that Hamilton

County has struggled with a recent budget proposal that entails a $60 million, or 23%, cut from

2008. Said Sigman, “House Bill 223 will provide targeted relief for two of our mandated

departments: county prosecutor and county treasurer. At the same time, the prosecutor’s office

and all county departments are facing major reductions in their 2010 budget, [while] the county’s

DTAC fund within the prosecutor’s office has built up a $3 million balance over the years.”

Mr. Signa further explained that based on current law, the DTAC funding only can be used for

delinquent tax collection activities and under recently enacted legislation, certain types of

foreclosure prevention efforts. Concluded Mr. Sigman, “This temporary authority will go a long

way in assisting the county prosecutor and county treasurer to mitigate the impact of the 2010

budget reductions.”
