This is one of those meetings that may well be referenced a good bit in the future.  It reminds me some of the January 25, 2010 meeting for the amount of subject covered but time will tell.

File 3 has Mindy Robbins in for her weekly General Fund Financial Update and of note was that this week there was no cash total given for the general fund. It was last reported to be at an historic high of $3,296,697.06.

 

File 6 had a discussion on among other things Commissioner Stonecash’s August 22, proposal to raise county non union county employee pay by up to 3%. No figures on the projected cost of doing so were released on the audio. At the August 24, meeting it was revealed that the Sheriff had asked deputies to try an average 30 mile per shift less on their cars to save fuel expense.

 

File 7 restarts an ongoing point of contention over financial issues between the Preble County Commissioners and the Preble County Ag Society.

Bob Stonecash (up for re-election in 2012) mentions the Preble County Commissioners giving the Ag Society “tower checks”. Commissioner Wesler recently proposed that the check be with held and the put in a separate account to be used for capital improvements at the Fairgrounds. The idea is sound but there is contention of whether the Preble County Commission should even be getting the tower rental check.

The issue here is that if the Ag Society has control over the Fairgrounds via ORC (they do) then the checks should be going to the Ag Society first instead of the Preble County Commissioners. I recently received an email with a court case cited and the issue is best explained in a case dated December 30, 1993, – OPINION NO. 93-074.  Off hand it looks to me like the rental check belongs with the Ag Society, with no strings attached. The Commission argument is summarized on page 5.  There is no doubt in my mind that the Ag Society had control of the Fairgrounds at the time and continues to exercise that control. The Ag Society does not run building or grounds rental through the Preble County Commission and the funds raised from those endeavors goes into the Ag Society general fund for operations and to maintain the Fairgrounds.

The tower rental check going through the Commission allows the Commissioners to inflate the amount of money they can claim to have given the Ag Society. The issue is; was it theirs to give or does that tower rental rightfully belong to the Ag Society? If that money is subtracted from the amount the Commission allocates to the Ag Society then Preble County falls down the ladder of financial support when compared to other counties. That short fall grows in magnitude when it is considered that Preble County is very much an agricultural county. At that point there is indeed an argument that the Preble County Commissioners are woefully neglectful of what is the biggest tourism draw in the county. I’ll remind this Commission that earlier this year the economic development director claimed that every $1 spent on tourism resulted in a $13 return. This commission used that bloated figure as an excuse to pursue an additional 3% tourism tax that will now put Preble County lodging as a competitive disadvantage to Oxford and Richmond.

1.Pursuant to R.C. 1711.31, the control and management of lands and improvements owned by a board of county commissioners for the purpose of holding agricultural fairs shall be vested in the board of directors of an agricultural society so long as the agricultural society occupies the land and improvements and uses them for holding agricultural fairs.

2.When an agricultural society ceases to occupy and use for holding agricultural fairs a portion of the land and improvements it had previously occupied and used pursuant to R.C. 1711.31, the control and management of that portion of the land reverts to the board of county commissioners.

File 8 has an underwhelming Economic Development Update.

File 9 has another discussion on the makeup of a Convention and Visitors Bureau (CVB).  Last meeting had the proposed size of the board at between 20 and 50 people which I felt was utterly ridiculous but not unexpected from this commission. This meeting finds the number proposed has dropped to between 6 & 10.

File 10 has the revisiting of the “tower rental” money at the Fairgrounds and a motion from Commissioner Stonecash that to me at least makes the case on the record in favor of the money rightfully belonging to the Ag Society. His motion “I move that we take the tower rental check that we receive from the tower placed upon the Fairgrounds that has been in the past going to the Ag Society and placed in their General Fund. That we hold that money in an account to once a year or whenever we deem appropriate to be used for capital improvements at the Fairgrounds.”

Acknowledgement of the tower being on the Fairgrounds would seem to support the Ag Society claim.

That motion passed 3 – 0.

File 12 continues an ongoing issue of who is responsible for maintenance of the Health Department Building.

File 13 has Commissioner Stonecash bringing up Goose Creek, the opposition to it, what he feels is misinformation and another apparent presentation being put together for the public to explain the dollar and cents and where the money is coming from. He feels there has been an attempt by opposition to promote the idea that the Commissioners will bankrupt the county. He goes on from there.

File 14 is a lengthy meeting that has a presentation to justify raising the landfill assessment. The audio is poor but the intent is clear.

Commissioner Stonecash – Reports back on Auglaize County.  Ag Society runs it. They do appropriate $42,750 to the fairgrounds and also gave them $15,000 for a new roof last year.

Bob, mentions the Preble County Commissioners giving the Ag Society "tower checks". The issue here is that if the Ag Society has control over the Fairgrounds via ORC (they do) then the checks should be going to the Ag Society first instead of the Commissioners. As an example the Ag Society rents out buildings for events and that money does not go to the Preble County Commissioners, it goes to the Ag Society and is used for Fairground expenses. If you accept the fact that the Ag Society has the right to rent buildings on the Fairgrounds then you pretty much have to accept that the "tower rental" should be going directly to the Ag Society and not to the Preble County Commissioners.  The check going to the commissioners allows them to wrap themselves in self righteousness by returning to the Ag Society what should rightfully have been theirs all along.  The point being that if that tower rental belongs to the Ag Society then the Preble County Commissioners have no grounds to dictate how the money is used anymore than they would the rental of buildings for events. This Preble County Commission has over stepped its authority. Doing this allows the Preble County Commissioners to inflate the amount of money they claim to "give" to the Ag Society.

Commissioner Stonecash – Just thinking out loud. Is it good to have 30 or 50 people on that board or 12? Or 6?

Commissioner Day – I think

Commissioner Stonecash – Just because we have a ahh October Fest or Pork Festival or Fair or car show does that mean those people need to be represented on that board? Or do you get driven people that get the job done?

Commissioner Day – I think that ahh in thinking about that after our discussion last Wednesday. We're going to need to find some good people cause they are going to have to be taking on responsibilities of an employee and payroll. Ahh you know budgets.

Commissioner Wesler – Oversight.

Commissioner Day – Oversight to drive this person in the direction that needs to be driven for the reasons that this is being established so. Initially you are probably right; it probably needs to be a small group of people that can make decisions and you know. Now as it progresses you might want to, hopefully once it is up and running, depending on who wants to be involved or how, that may involve to a different level. But ahh you are going to have to find some people that's going to be able to run a business.

Commissioner Stonecash – I don't think at this time, I'm still thinking out loud that you don't involve all the same people that are already involved in everything else. Pretty soon they are going to get burned out on everything. You know there is a lot of people out here that have an interest in Preble County, what happens in Preble County. That are driven if you will. So even saying that ahh would all twelve townships need to be represented?

Commissioner Day – I think you need a small group to get started. You are going to need somebody with some financial experience. Be nice to find someone that had some knowledge of a non for profit, how they work. There are certain limitations that you can and can't do.

Commissioner Stonecash – So are you saying an accountant?

Commissioner Day – If you had someone with some accounting experience it would be great. I just know that there is going to be quarterly reports that are going to have to filed with the IRS and year end taxes. You know you are going to have to look at all that stuff you are going to have to have it's a non for profit, if there are additional monies that are contributed for whatever reason. You know for advertising or whatever you are going to have to be able to deal with that.

Commissioner Wesler – I was thinking somebody out of one of the Chambers could possibly step to the plate and take on that position.

Commissioner Stonecash – There is surely someone. I am sure there is more than one that could step up.

Commissioner Wesler – ahh well we've been at it both ways. We've talked about having a large committee and now the discussion has turned to a smaller committee.

Connie – Dave would you like me to see if the gentleman at the state level would like to come down and speak with us about it. Come in and meet with us.

Commissioner Wesler – Is he available to is he agreeable to come down? This is something we need to start getting finalized because. I don't think it is rocket science here; we just have to get the right people on the board and to show up and have an interest in what is going on with tourism in Preble County.

Commissioner Day – When did, did we determine when monies would be available to even start this?

Commissioner Stonecash – The money doesn't start kicking in until the first of September, right? It's going to be collected quarterly so first of the year.

Commissioner Day – First of the year. That's the soonest.

Connie – September the first. This would only apply to areas in the county in townships where the township trustees did not levy the tax before the county. The two major tax producers are Israel and Jefferson and I have a letter advising me that essentially no tax will be collected until the township tells me so.

Commissioner Wesler – Should be available the end of October. I thought it was 30 days after the end of the quarter.

Connie – But we changed it. We changed the effective date because we made it effective on upon passage of the resolution. That was my error because no one had been notified to collect it from the people that lodge. So we changed the effective date until September 1, in order for Mindy to get out the information to all those lodging.

Commissioner Day – Has she done that?

Connie – Well she has not given me a copy if she has. I hope she has.

Commissioner Wesler – So once again when is the effective date? LOL, good grief you guys need to keep a better handle on what is going on.

Connie – You'll be able to collect one month and by October 31, you should have that in. Maybe from Monroe, Twin and Harrison but probably not Israel and not Jefferson.

Commissioner Wesler – That is what I am saying. And you are all at least partially wrong. We're wanting to know when the first monies will be October 31.

Commissioner Day – Ok.

Commissioner Wesler – And it will be a third of a quarter.

Connie – You are right David.  

Commissioner Day – Ok how much money I am trying to remember. We are still not going to be able to hire anybody until the first of the year.

Commissioner Wesler – Ahh probably.

Commissioner Day – I guess is where I was going with that. I was trying to remember, I knew we had to change that. I was trying to get it straight in my mind so realistically your I would say the first of the year is the soonest you are going to be able to hire. Commissioner Day – We should be able to get some cost estimates we're working on the treatment part of that. They haven't got I mean get some more realistic other than it could be in this range. Ahh they're supposed to have ahh the concept of what what they're they're thoughts are that components all put together and submitted to us this week?

Connie – It should be yes.

Commissioner Day – This week or next week. Once we get those they should be able to give the actual estimates off of those.

Commissioner Stonecash – Because I think there is confusion as to payment how payments are going to be made and where the money is coming from. And these people that are opposing it are feasting upon misinformation that they themselves are putting out. I think we need to set the record straight as quickly as possible.

Connie – I think once that information is received, I've got an email into Frank Leon as well to clarify what's covered in this construction loan.

Commissioner Stonecash – Yeah there is people afraid off that we are trying to bankrupt the county and that is absolutely not the case.

Commissioner Day – I've said once we get these numbers we will have the actual dollars and then that is when we as far as the construction thing that is when we got to start looking at financing. I mean

Commissioner Stonecash – And we need to tell the people that ahh the people of Preble County.

Commissioner Day – We have the financing through the design part of it, we've got that hammered out. The only ones we don't have is the construction of the facilities because we didn't have that far enough along to get yeah we had general.

Commissioner Day – But until it's like building a house, until you can actually find how many rooms you're going to be used and how many bathrooms it's going to use then you can actually get you costs down and that is where we are at.

Connie -I understand that. The opposition to the project doesn't. I think they understand it, they choose to spin it their way. To make it look bad. I just want to spin it the correct way.

Commissioner Day – We should have I think we should have most of that this week. Supposed to get thee ahh plans to us for review and things like that. and then that's once once everybody is fine with that then we start the design work. I can get the dollars on components and things. Ahh we will get those as soon as we can.

Steve Simmons – I might open it up, we were asked to take a projections as far as landfill cost. Different projects that will be coming up the next few years.

2 hr.  21.25 Minute mark  Cost savings estimate put at $140,000 a year once the force main is operational to Lakengren.

Tier Two Sampling once every five years cost $100,000.

Emissions fee of $2,000 per year.

Equipment replacement over the next five years averages out to about $294,000 per year.

Payback to the General Fund – $100,000 per year, through 2016 and a small balance in 2017.

Construction projects that are upcoming:

Did not include anything for the gas collection system.

2008 actual expenses went up to $3.2 million and revenue was $2.9 million.

2009 expenses a little over $3 million – revenue $2.9 million

2011 we have expected expenses going over $3 million again and revenue will be less than that.
